MILTON — The Milton common council unanimously voted Tuesday to remove the sunset clause on the ATV ordinance and the vehicles will continue to be allowed within city limits.
In May of 2024 the city council approved Ordinance 533 that allows the use of ATV/UTV on city streets.
In August of 2024, the final signs were installed, and the city opened its streets to ATVs and UTVs. The city council placed a provision in the ordinance to terminate the ordinance after one year, unless the city council acted and approved another ordinance. This ordinance would allow the continuation of ATV/UTV use on city streets in the same manner as the previous year.
According to the memo, the council determined there had been no reports of significant violations of the ordinance and there have been no safety concerns regarding ATV/UTV operation on city streets that have been communicated to the common council.
Paul Hensch, city administrator, said Chief Brandon Sachse found very few incidents that caused any concern, way less than he thought there would be.
Alderperson Ken Smith said he has talked to residents and they have said that it makes driving down Madison Avenue more fun.
“People are overwhelmingly happy with our decision to allow this in the city and if we can do that and have this be a fun place to live, I’m all for it,†he said.
Mayor Eric Stockman said he feels like he rarely sees them in the city. But Hensch said they may be seeing more this summer as the township has recently passed the ordinance that allows ATVÃÛèÖÊÓÆµ in the township.
Three-wheel ATVs are not allowed. Also, all operators are required to have valid insurance and a valid driverÃÛèÖÊÓÆµ license after a recommendation.
